Terms & Conditions
1. Introduction These Terms and Conditions (“Terms”) govern the provision of property photography services (“Services”) by The Property Photo Pro (“Photographer”) to the Client (“Client”). By engaging the Photographer, the Client agrees to these Terms.
2. Scope of Services 2.1 The Photographer will provide photography services as specified in the agreed quotation or project brief via estate agent 2.2 Any additional services not outlined in the initial agreement will require a separate agreement and may incur additional charges.
3. Booking and Payment 3.1 A booking is confirmed upon receipt of confirmation email from the Photographer 3.2 Full payment is dealt with estate agent unless agreed otherwise. 3.3 Late payments may incur fees.
4. Cancellation and Rescheduling 4.1 Cancellations made by the Client with less than 12 hours notice will incur a cancellation fee of 1/3rd of the agreed services. 4.2 Rescheduling requests are subject to availability. 4.3 If the Photographer needs to cancel or reschedule due to unforeseen circumstances, the Client will be offered an alternative date or a full refund. 4.4 Weather does not dictate the cancellation of an appointment. Elements of the shoot can still go ahead regardless.
5. Intellectual Property and Usage Rights 5.1 The Photographer retains copyright of all images created. 5.2 The Client is granted a license to use the images for the agreed purposes, typically marketing and promotional use related to the property. 5.3 The images must not be sold, altered, or used for purposes outside the agreed scope without prior written consent. 5.4 The Photographer reserves the right to use the images for portfolio, marketing, and promotional purposes unless the Client explicitly requests otherwise in writing.
6. Preparation and Cooperation 6.1 The Client is responsible for ensuring the property is prepared and presentable for photography prior to the agreed time, please see confirmation email on how the property should be presented. 6.2 The Photographer is not responsible for cleaning, tidying, or rearranging items unless explicitly agreed. 6.3 Any delays caused by the Client or their agents may result in additional charges. 6.4 The appointment may be cancelled due to the property not being in a state for photography. The Client would be charged in full.
7. Limitations and Liability 7.1 While the Photographer will take reasonable steps to capture high-quality images, specific outcomes cannot be guaranteed. 7.2 The Photographer is not liable for delays or issues caused by weather, lighting conditions, or third parties. 7.3 Any claims for defects or issues must be made in writing within 7 days of delivery of the images. The Photographer’s liability is limited to reshooting the property.
8. Delivery 8.1 Media will be delivered digitally within 48 hours (usually the next day) of the shoot unless otherwise agreed directly to the estate agent. 8.2 High-resolution files will be provided, suitable for print and digital use.
9. Data Protection 9.1 The Photographer will comply with the Data Protection Act 2018 and GDPR regulations. 9.2 Any personal data collected will only be used for the purposes of delivering the Services and as outlined in the Photographer’s Privacy Policy.
10. Governing Law These Terms are governed by the laws of Scotland. Any disputes will be subject to the exclusive jurisdiction of the courts of Scotland.
11. Entire Agreement These Terms constitute the entire agreement between the Client and the Photographer. Any amendments must be made in writing and agreed by both parties.
12. Acceptance of Terms By engaging the Photographer, the Client confirms acceptance of these Terms and Conditions.
